1. Definitions
In these Terms and Conditions:
- "Service" or "Services" refers to the apartment rental consultation and placement services provided by Horizon Living
- "Client" or "You" refers to individuals or entities engaging our services
- "We," "Us," or "Our" refers to Horizon Living
- "Agreement" refers to the acceptance of these Terms and the engagement of our services
- "Property" refers to residential apartments and accommodations presented through our services
- "Collection" refers to our Essential, Premium, or Complete service tiers
2. Acceptance of Terms
By engaging our services, accessing our website, or submitting an inquiry, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, you should not use our services.
You must be at least 18 years of age and have the legal capacity to enter into binding agreements to use our services. By engaging our services, you represent and warrant that you meet these requirements.
3. Service Description
Horizon Living provides professional apartment rental consultation services in Taiwan. Our services include:
- Property search and recommendation based on client requirements
- Viewing coordination and property presentation
- Lease documentation review and guidance
- Negotiation support with property owners
- Administrative assistance with rental processes
- Ongoing support as specified in the selected Collection tier
Specific services provided depend on the Collection tier selected (Essential, Premium, or Complete). Detailed descriptions of each Collection are available on our website and in service agreements.
4. Service Availability
Our services are primarily available for properties located in Taiwan. Service availability may vary by region. We reserve the right to decline service requests based on geographic location, property type, or other factors at our discretion.
Property availability is subject to market conditions and property owner decisions. We do not guarantee the availability of any specific property or that suitable properties will be available within any particular timeframe.
5. Client Responsibilities
As a client of Horizon Living, you agree to:
- Provide accurate, complete, and truthful information regarding your requirements and qualifications
- Respond promptly to communications and requests for information
- Attend scheduled property viewings or provide reasonable notice of cancellation
- Review all documentation carefully before signing lease agreements
- Comply with Taiwan's laws and regulations regarding rental housing
- Conduct yourself professionally in all interactions with our team and property owners
- Inform us immediately of any changes to your requirements or circumstances
- Maintain confidentiality of property information shared for your consideration
6. Fees and Payment
Service fees vary by Collection tier as published on our website. Current fees are:
- Essential Collection: TWD 23,000
- Premium Collection: TWD 77,000
- Complete Collection: TWD 134,500
All fees are quoted in Taiwan Dollars (TWD) and are subject to applicable taxes. Payment terms will be specified in your service agreement. We reserve the right to adjust fees with 30 days' notice for future engagements. Changes do not affect existing agreements.
Service fees are separate from rental payments to property owners. Clients remain responsible for rental deposits, monthly rent, utilities, and any other costs associated with their lease agreements.
7. Refund Policy
Service fees are generally non-refundable once services have commenced. Specific refund provisions, if any, will be outlined in your service agreement. Circumstances that may qualify for partial refund consideration include:
- Our inability to provide services due to circumstances within our control
- Material breach of service agreement by Horizon Living
- Cancellation within specified timeframes before service commencement
Refund requests must be submitted in writing to [email protected] and will be reviewed on a case-by-case basis.
8. Intellectual Property
All content on our website, including text, graphics, logos, images, and software, is the property of Horizon Living or our licensors and is protected by Taiwan and international intellectual property laws.
You are granted a limited, non-exclusive, non-transferable license to access and use our website and services for their intended purpose. You may not:
- Reproduce, distribute, or create derivative works from our content without written permission
- Use our trademarks, service marks, or branding without authorization
- Extract property data for commercial purposes or database compilation
- Reverse engineer or attempt to access source code of our systems
9. Disclaimers
Our services are provided on an "as is" and "as available" basis. While we strive for accuracy and quality, we make no warranties or representations regarding:
- The suitability of any property for your specific needs
- The accuracy of property information provided by property owners
- Outcomes of lease negotiations or property availability
- Uninterrupted or error-free operation of our website or services
- Future property value, rental rates, or neighborhood conditions
We provide professional guidance based on our knowledge and experience but do not offer legal, financial, or investment advice. Clients should consult appropriate professionals for such advice.
10. Limitation of Liability
To the maximum extent permitted by Taiwan law, Horizon Living and its officers, employees, and agents shall not be liable for:
- Indirect, incidental, consequential, or punitive damages
- Loss of profits, revenue, data, or business opportunities
- Damages arising from property owner actions or lease agreement terms
- Damages resulting from client decisions or actions
- Amounts exceeding the service fees paid by the client
This limitation applies regardless of the basis of liability, whether in contract, tort, or otherwise, even if we have been advised of the possibility of such damages.
11. Indemnification
You agree to indemnify, defend, and hold harmless Horizon Living, its affiliates, and their respective officers, employees, and agents from any claims, liabilities, damages, losses, costs, or expenses (including reasonable legal fees) arising from:
- Your violation of these Terms and Conditions
- Your violation of any applicable laws or regulations
- Your lease agreement or relationship with property owners
- Inaccurate or misleading information you provide
- Your conduct during property viewings or interactions with property owners
12. Termination
Either party may terminate the service agreement under the following conditions:
Client Termination: You may terminate services by providing written notice. Fees already paid for services rendered are non-refundable unless otherwise specified in your service agreement.
Our Termination: We reserve the right to terminate services if you:
- Violate these Terms and Conditions
- Provide false or misleading information
- Engage in disrespectful or unprofessional conduct
- Fail to meet payment obligations
- Request services that are illegal or against our policies
Upon termination, any obligations that by their nature should survive (including payment obligations, confidentiality, and limitations of liability) will continue to apply.
13. Dispute Resolution
These Terms are governed by the laws of Taiwan. Any disputes arising from or related to these Terms or our services shall be resolved as follows:
Informal Resolution: Before initiating formal proceedings, parties agree to attempt good faith negotiation for at least 30 days.
Jurisdiction: If informal resolution is unsuccessful, disputes shall be subject to the exclusive jurisdiction of the courts in Taichung, Taiwan.
Language: All proceedings shall be conducted in Mandarin Chinese or English as mutually agreed.
14. General Provisions
Entire Agreement: These Terms, together with your service agreement and our Privacy Policy, constitute the entire agreement between you and Horizon Living regarding our services.
Severability: If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
Waiver: Our failure to enforce any provision of these Terms does not constitute a waiver of that provision or our right to enforce it in the future.
Assignment: You may not assign or transfer your rights or obligations under these Terms without our written consent. We may assign our rights and obligations to any affiliate or successor entity.

15. Changes to Terms
We reserve the right to modify these Terms at any time. When we make material changes, we will:
- Update the "Last Updated" date at the top of this document
- Post a notice on our website
- Notify active clients via email when appropriate
Changes become effective 30 days after posting. Continued use of our services after changes take effect constitutes acceptance of the modified Terms. Active service agreements remain subject to the Terms in effect at the time of agreement unless otherwise specified.
